Agreement for Repair

The terms set out in these Conditions of Repair (“Agreement”) shall apply to the service we provide to repair your mobile device on the collection receipt.

All repairs

This Agreement shall commence from the date you pass the device to an iLab member of staff and shall continue until we have repaired or otherwise returned your device and received payment from you.

We shall make all reasonable efforts to repair your device, subject to the availability of any parts required. We shall perform the Services using our reasonable care and skill.

Any time estimate for completion of the service which may be given to you is an estimate only and does not form any obligation under the terms of this Agreement.

We shall notify you when the device has been repaired and is available for collection. If you do not collect the device within 90 days, we may dispose of the device. Any sum obtained on disposal will be used to meet any unpaid estimate or repair charges you are liable to pay and any remaining balance will be sent to you or will remain payable by you accordingly.

If we are unable to complete the Service for any reason, or the Service will incur further costs payable by you, we will notify you immediately.

Warranty

Our out of warranty/chargeable repairs are guaranteed with a one year performance warranty for screens and 90 days for all other component parts, from the date the device is returned to you from our store. If the device develops an additional fault unrelated to the original repair within 48 hours of the repair, our technician will carry out the repair. Any unrelated fault that occurs outside of this 48 hour window will not be covered. The warranty includes the repaired part(s) only and does not include further damage to the repaired part(s).After this time period has lapsed, the repair warranty contained in this paragraph will not apply.

Water damage - We cannot offer a warranty on any device that is water damaged whether it is claimed to have had, or has been discovered to have had by one of our technicians.If we discover previously undisclosed water damage whilst repairing your device we will immediately stop the repair and contact you for your authorisation to continue with the repair.

Loss of data – Where possible we always advise you to perform a back-up of your device before it comes in for repair.Any data or information that you may have stored on the device shall remain your sole responsibility and we accept no liability for loss or corruption of such data howsoever caused. It is your responsibility to keep a record of any such data.

We shall make all reasonable efforts to repair your device subject to the availability of any parts required. We shall perform the Services using our reasonable care and skill.

We may, in certain circumstances, send your device to another repair centre and sub-contract the work to a third party.

We are not liable for the breach of any existing warranty you may have with the manufacturer of your device, by our carrying out the requested repair on your device.

Liability

Our entire liability in respect of any single cause of action arising out of or in connection with this Agreement or its subject matter (whether for breach of contract, tort, including negligence, statute or otherwise at all) shall be limited, to the extent that the cause of action related to our supply of the Services, at our option to: (a) supplying the Services again; (b) payment of the cost of having the Services supplied again; or (c) repaying to you any amount that you have paid in respect of the Services.

If, through our negligence or willful misconduct, we damage the device beyond economical repair, our liability will be limited to the cost of providing a replacement with a product that is the same as or similar to the device.

Nothing in this clause shall apply so as to limit or exclude our liability for: (a) death or personal injury resulting from our negligence; (b) breach of any terms implied by statute; (c) any claim arising under the Consumer Protection Act 1987; or (d) fraudulent misrepresentation.

In no circumstance shall we be liable to you for any indirect, special or consequential loss arising out of or in connection with this Agreement, including any loss of business, revenue, profits, anticipated savings, goodwill or any other indirect or consequential loss or damage howsoever arising.

Except as expressly provided in this Agreement, all representations, conditions and warranties, whether express or implied (by statute or otherwise) are excluded to the fullest extent permitted by law.

We shall not be liable for any claim arising under this Agreement unless you give us written notice of the claim within three (3) months of becoming aware of the circumstances giving rise to the claim or, if earlier, three (3) months from the time you ought reasonably to have become aware of such circumstances.

Data Protection

We ask for your name and address and the other details (“Personal Information”) during the ordering process so that we can notify you when your device has been repaired and so we can give you an efficient after-sales service.From time to time we may also notify you of other services from the ilab Repair Centre that may be of interest to you. By using thisService you consent to our use of your Personal Information as described.

General

We shall not be liable to you for any delay in or failure of performance of our obligations under this Agreement arising from any reason beyond our reasonable control.

Our failure to exercise or enforce our rights or the giving of any forbearance, delay or indulgence, will not be construed as a waiver of such rights under this Agreement or otherwise.

This Agreement sets out the entire agreement and understanding between you and us in connection with its subject matter. Nothing in this Agreement shall effect our liability in respect of any misrepresentation, warranty or condition that is made fraudulently.

If any part of this Agreement is found to be void or unenforceable it will be severed from the rest of this Agreement so that it is effective to the extent that shall not effect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.

Nothing in this Agreement shall confer on any third party any benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.

This Agreement shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.

How does it work?

  1. Call us on 01271 323036 to tell us which device you have broken and where you are?
  2. We can then arrange a convenient time for one of our skilled technicians to visit you for a one hour repair on your device.
  3. We come and repair your device at your location and you can carry on with your day!

All We Come to You appointments are subject to a £15 call out fee payable at the time of repair. All of our screen repairs are covered by a 12 month performance warranty.

* We Come to You repairs can be carried out within a 15 mile radius of our Barnstaple store, call us to see if you are in our serviced area.


Terms and conditions :


The standard terms and conditions of the ilab Repair Centre (available to view at www.theilab.co.uk) apply to all We Come to You repairs and also include the additional terms below:


  • On arrival at your appointment our technician will carry out standard checks on your device, if it is discovered at this point that the repair is unable/no longer required, to be carried out due to faults that were not declared to us at the time of booking our £15 call out fee will still be chargeable.

  • Upon completion of the repair you have 48 hours to get in contact if there is anything you are unhappy with following the work we have carried out.
  • We offer a 12 month performance warranty on all of our screen repairs (unless there is a reason no warranty was offered), this performance warranty is voided if there has been any other accidental damage including water damage to the device.

  • Whilst we always carry out our repairs in a professional manner with a skilled and experienced technician we cannot be held liable for the loss or corruption of data during a repair. To this end we recommend that you always, where possible, back up your device before your appointment.

  • Any personal information you provide to the ilab is used to:
  1. ​provide our repair service,
  2. ​enable us to contact you regarding your appointment,
  3. ​process your payment and, from time to time, contact you regarding similar products or services that we provide that may be of direct interest to you.


Price and payment

The price quoted to you for your repair is based upon information provided by you in relation to its exact model and fault. As such, this quote is subject to change at your appointment, if our technician discovers during his or her checks that the model or fault details given to us have been incorrect and/or if we discover that there are additional or alternative defects on your device.

If, as a result, you decide not to go ahead with your repair you will only be charged your £15 call out fee.


Cancellation

We will contact you on the day of your repair to re-confirm the appointment and you have up to this time to cancel. After this time, you will be charged our £15 call out fee.


Liquid damage

If your device is found to be liquid damaged, and this was not declared at the time of booking, we reserve the right to charge out £15 call out fee if your requested repair does not take place as a result. We guarantee no success for the repair of liquid damage devices and our no fix, no fee policy does not apply.


Unforeseen circumstances

Should unforeseen circumstances occur during our repair, our technician may need to take your device back to the ilab Repair Centre in Barnstaple for further investigation. On completion of such investigation your device will be delivered back to your location within an agreed timeframe.


No fix, no fee

the ilab operate a no fix, no fee policy towards the repair of your device, which means, if we cannot repair your device, you do not pay a charge in relation to the device that has not been repaired. No fix, no fee does not apply in relation to liquid damage or any element of a completed repair, ie. if your repair requires a screen replacement (completed), home button (not completed), the no fix, no fee policy will only apply to the home button but you will still pay for your screen.


Gift Vouchers

  • Gift vouchers are redeemable against any merchandise or repairs in-store.
  • Gift vouchers cannot be redeemed online
  • Gift vouchers are non-transferable, cannot be exchanged for cash or used for the purchase of gift vouchers.
  • For purchases where gift vouchers offered have a greater value than the goods being purchased, change will be returned to your gift card.
  • Gift vouchers must be submitted upon redemption in-store.
  • Gift vouchers cannot be replaced if lost, stolen or damaged.
  • The ilab reserve the right to refuse to accept a gift voucher which it deems to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected from fraud.
